Non-delivery of replacement phone ripoff

Having once been a former customer of Worldcom, then AT&T, I had an offer from SBC, my local phone service to upgrade to a Cingular Motorola phone, thereby disconnecting my old one. I went along with this offer last September and was informed I'd be receiving my "updated and new" phone by Cingular within 2 working business days via FedEx. Unfortunately, my new phone was mis-delivered to the wrong apartment number at my home address by FedEx, without any verification by the FedEx driver.

This I didn't know until, after waiting a week, I contacted Cingular Customer Service and was informed that FedEx had delivered the phone. I told Cingular that FedEx had delivered the phone to the wrong apartment number, but that only the address was correct, and to please re-deliver a new phone to me. Only by accessing the FedEx delivery website, did I see that either SBC or Cingular or FedEx had a wrong apartment number. Since, according to Cingular, said phone was signed for, they would submit my inquiry as a "lost" phone and indicated that a new one would be sent out and that I was to receive it within 5-7 business days.

I never got this replacement phone. Cingular supposedly over a month's time, had indicated they were looking into the matter and that I would be getting my phone. It still never happened. I again, for the 5th time within a month, contacted Cingular and indicated that irregardless of another tennant mistakenly signing for a phone that didn't belong to them, I still had not received a replacement phone to use. Nor could anyone else use the phone, according to Cingular, as you needed to input verification idenities in order to activate the phone. Cingular admitted that the new phone wasn't in use by this fact, but they still lied about re-sending a new phone to me, when I'd receive it, etc.

Over the course of 2 months, I never got a replacement phone as neither Cingular nor SBC admitted to any wrongdoing in reference to getting my apartment number wrong. The initial charge of this phone was reimbursed to me, but it took about 4 months to settle this, but to date, I still have no phone. I will never, ever trust or use Cingular for any future cell phone purchases.
