Rebate ripoff Deceptive and misrepresenting rebate offer on 5/15/05 to present

On May 15th I made a verbal contract with Cingular Wireless during a tele-marketing sales conversation to the following: 1. I would purchase a new Samsung Wireless (model SGH-X27M). 2. Use their service for two years. 3. Pay their billing correctly and on time. They would: 1. Refund my order with a $50.00 rebate within 60 to 90 days. 2. Provide me with proper wireless telephone service.

This never happened!

After 90 days, Cingular failed to honor their contract since they never sent the rebate. It was once again promised within 30 days. That never happened. Several telephone call later, I was sent a Visa Debit Card that they said would allow me to shop and purchase $50.00 worth of goods. It arrived seven months from 5/15/05, or early December.

After purchasing Christmas gifts in a Major Department store, the Visa card wouldn't work in the swipping part of their computer. A store supervisor was called to try her luck and the Visa Card froze the computer. And yes, prior to using the visa Card, I had it properly authorized as they required.

A call was made to Cingular to explain their last insult to me. My request was simple. Send me the rebate. Their operator said they could only credit my account. I told him that due to his rudeness, and the company's failure to honor their contract with me properly, I no longer had an account and to end all my business between us.

Cingular had one last insult to bestow on me, they charged me $150.00 for their early withdrawal of the verbal contract by their deceptive and misrepresentation of the contract.

I have sent them a demand letter for all monies paid to them for services after August 15 to present, the full purchase price for the Samsung Telephone and the $50.00 rebate. I gave them 30 days to respond on April 22. I have not heard further from them. At that time my option will be a Houston Small Claims Court.
