Installed mismatched AC Heat pump

Closed on new home 2006. Contract called for 12 seer heat pump. On inspection found 10 seer unit installed. Outside unit was replaced leaving 10 seer inside unit. Two years later the unit is flooding the house. Soaked drewall, carpet, ECT. They will not respond. They claim a mix of 12 seer and 10 seer is fine. Many articles indicate this is wrong and now ilegal. Flooding continues one month.
