Unethical business practice - Metro PC cell phone

Selling used phone as a new one. Everyone direct you to someone else, no one want to take responsibility for replacing my used phone for a new one that it was intended to be. I don't want my money back, just a new phone that I was under the impression I was receiving. Customer service is a joke and so was the regional corporate store in Jacksonville Florida. They offer to help me by trying to sell me another phone, great service, that will really boost up business if all are idiots. I'm stuck with a discontinue crappy used phone that I paid $80.00 thinking it was new and no one wants to accept responsibility. Small claims will probably have to be my next stop. I want my phone replace for a new one that's what I paid for, that's what I want. My patience are running short, if I have to, I'll fille at small claims court for my money or replacement, but this is my last attempt to seek your final help.
