I retained the services of this law firm for representation on a property dispute.

In our initial consultation, we met with Mr. David Ginn to discuss our case.

In order for my Husband and I to make a decision regarding whether the cost of pursuing the case was worth the risk, we asked to be provided with a "worst case scenario" estimate of the costs associated with representing us in this action.

Mr. Ginn defined a worst case scenario as being one in which the opposing counsel would file motion after motion to delay the process and would eventually result in a court trial. He provided us with a dollar amount he considered to be an accurate "ball park" based on his experience in addition to his assertion based on the known facts of the case at that time that we had a strong likelihood in prevailing.

We were provided legal advice as to best course of action in meeting our goals in the matter. After careful consideration we decided to proceed and retained the Law Offices of David W Ginn as Counsel in our defense.

After several months the invoices received from the firm for representation in the case had already exceeded the intial worst case estimate provided to take us all the way to trial!

I started to protest and was advised of the option to file a claim with my insurance carrier for reimbursement of costs associated with legal counsel to lift some of the financial burden from our shoulders.

We were initially confused. Why hadn't we been advised that this was an option previously? Why was it only coming up now when we were starting to grumble about the amounts we were being billed?

We filed the claim for legal counsel cost reimbursement with our insurance carrier only to subsequently learn from the Insurance Carrier Assigned legal Counsel that IF the insurance carrier was able to negotiate a settlement with the plaintiff on our behalf and we did not accept it, we forfitted any and all insurance coverage associated with the action.

The Law Offices of David W Ginn did not inform me of the fact that I would completely forfit any right to my counter suit which was and had been since day one of initial consultation the recommended legal course of action plan set forth to us by The Law Offices of David W Ginn.

When I inquired as to the reason the costs for representation so far exceeded the original worst case estimate, I was informed that "As to the amount of our invoice, the multiple motions filed by opposing counsel significantly affected your costs in this case"

After two depositions at which confidential documents were handed over to opposing counsel by this firm without prior consent, The Law Offices of David W Ginn informed us they were no longer interested in representing us in this case and were planning to "withdraw from our representation in this case."

This action just so happend to coincide the Insurance Carrier provided Counsel's ability to negotiate a settlement with the Plaintiff within several days of entry to the case. This settlement negated any future coverage for private legal counsel cost reimbursement.

When all was said and done, The Law Offices of David W Ginn charged more than double the original estimate within the first months of representation in the case with no trial date even in the works yet.

Subsequent to the firms notice of intent to withdraw from their representation in this case, I had several conversations with members of the firm that previously worked on the case. I wanted some specific answers for the reasons the case went down the way it did. For these conversations, I was charged full billing and subsequently placed into collection
