Holding of Security Deposit

On January 31st, I meet with the realtor and did the walkthrough of the apartment we were renting. The agent asked me to sign the paper and she did signed too. A week later I received a letter informing me that they will use part of the security deposit to re-paint the unit. We made an arrangement with the landlord about the price and everything went fine. It has been almost two month and I still waiting to receive the remaining of the deposit. The agent is telling me that the Property Management is holding the deposit and that they can’t return the balance until they receive the money from the Management. I understand that legally they can’t take more than 40 days to return the deposit and the time keeps passing on and I still haven’t receive my money.
