Pay for new phone get one used

I paid for a new LG-MS690, I stared learning about the new fixtures, and I found a video from other user, also when I went to MetroPCS store they scanned the bar code and found that the phone was previously with another number that wasn't main, conclusion the phone wasn't new. Also the phone is turning off and I got disconnected very often and is not the service o connection, because I had before another phone and I never have these issues. I told them that I want a new phone but the just said that because I went to complain after 17 days is nothing they can do.
