Would not accept return on brand new Video camera NEVER OPENED

I bought a 300 dollar video camera as a holiday gift for my sister. I NEVER opened the camera. A couple of weeks latter when I attempted to return it, the store told me that the Camera wasn't properly factory sealed so I would have to pay a 15 % restocking fee. The Camera was as I bought it no tampering to the packaging AT ALL.

I don't agree with a 15 percent restocking fee in general. If an item is as bought and returned in a reasonable amount of time, why should one have to pay ANTYING to return an item.

But what makes my case so insinuous is that I DIDN'T OPEN THE PACKAGING. Cicruit City probably makes a killing off of people just like me who don't examine the packaging before an item is bought and wouldn't be able to distinguish a "factory sealed" item unless it was shrink wrapped. I am conviced either the sales person who originally sold me the camera knew it wasn't properly sealed, or the manager who made the determination that it wasn't factory sealed knew deceived me into believing it wasn't factory sealed when in fact it was.
