No service and lied too

I had a salesman from the solar panel company come to my house in the beginning of november of 08, we talked, and i said to him i want to have the panels installed, ok then he said if i write him a check right now he would take a couple of thousand off, and also telling me if there was a problem and the job didnt get done they would refund all of my money, the sales man was told at least 5 times what phone number to call and the right email, well he gave the number and the email that i never check or use to the banks so i never replied, feb. 17 i wrote that i think he should give me my money back because i didnt think it was going to happen, ten he told me about the people leaving messages and i didnt reply, long and the short of of it we agreed to move forward with the job and again i told john to use the right email and the right phone number, and as before he said ok??? So today i open my mail and there is a check in the box minus 1160 dollars well he only cc his boss of the one email he wrote, not the one with lets go do the job, the man said in my kitchen and told me that there is no charge if the job doesnt get done and well he lied
