James, Matthew (no longer there) said they would help negotiate a modification, and that it would NOT negatively affect my credit

I was contacted in August about modifying my loan. Matthew, from StarLoanMods, said that he rec'd my name from my servicer, Citimortgage, because they could not get to all of their customers calling in for assistance on refinancing and modifications. He said he was with a law firm, and worked directly with a modification company, and would take a look at my circumstances to see if they could help me with a modification. He said it would cost $2195-and 1/2 down up front, and the other 1/2 after 30 days. He said it would take as long as 90 days to get it finalized. He kept me informed along the way, and requested all of the loan documents: paystubs, bank statements, mortgage information/loan number, etc. He told me in November that he had successfully negotiated a modification.By this time, I had paid the full $2195. My payment was going to drop by $300. I had asked him repeatedly if in doing this, my credit would be affected. He assured me repeatedly that it would not be affected. The first payment (modified payment) was to be withdrawn from my account on Dec. 1. On December 3rd, I rec'd a call from my servicer, Citimortgage, inquiring as to where my payment was. I explained that I was working with their modification dept., and that the servicing dept. And modification dept. Needed to communicate. She indicated that she would transfer me to "collections". I asked her why that was necessary, and she informed me that while I was going through the 6 mo. Trial period, I would be looked upon as "late" and therefore would report negatively on my credit as a late mortgage, for a consecutive 6 months. I immediately informed her that i wanted to cancel the modification and pay in full, the $300 difference that was due at that time. I am off of the modification program, but was completely misinformed by StarLoanMods. When I tried to contact them back, the person with whom I originally spoke, "Matthew" was no longer there, and now I was just dealing with James. James told me that Citimortgage was incorrect, and were giving me wrong information, and that the modification would NOT negatively affect my credit. I called Citi back and they told me that James was wrong, and in fact, it would. I called James back and told him I wanted my $2195 back, and he told me he would "look into it" and has not called me back, or responded to my emails and voice mails. I am out $2195 (which I put on a credit card and have since paid) and am in my original loan with Citi, paid on time.
