High overdraft fees with inconsistent online account balance info

I noticed two days ago my account balance was over $500. Yesterday I checked my balance there were $74 dollars in overdraft fees, and I had a balance of about $360. I was confused, and called ameriserv customer service to ask how in the world could I be charged overdraft fees... And still have a positive balance? They explained that even though I had deposited money on friday, and the money was credited on monday, they went back and rearranged the transactions over the weekend from highest to lowest leaving me with a negative balance BEFORE crediting my deposit... All on the same day!

On March 22nd 2009 USA Today reported that:
Bank of America (BAC) recently agreed to pay $35 million to settle a class-action lawsuit related to overdraft fees. The lawsuit alleged that BofA authorized transactions that led to overdraft fees and posted transactions in an order that increased such fees.

The National Consumer Law Center has also sued Washington Mutual now part of Chase (JPM) for its overdraft policies.

The Federal Reserve was accepting comments about overdraft policies until March 30. Consumers e-mailed them to regs. Comments@federalreserve. Gov referencing Docket R-1343

This information lets us know that we aren't alone in our dissatisfaction!
I am filing an online compliant to the better business bureau on bbb.org, Ameriserv is not a BBB Accredited Business and they already have a compliant on file (no surpirse there). Let's complain together, either Ameriserv will respond with fairer practices Or more customers will continue to complain leading to a class action suit.
