Overdraft fees when account isn't negative

I would like to know how I can be charged multiple overdraft fees when my account balance has not gone negative.

This has happened several times, I have been charged overdraft fees for transactions that have not been posted to my account and my account balance is not negative and these transactions don't even show up as "pending".

I have read the banks glossary of terms regarding available balances and overdraft so technically according to their rules I should not be charged overdraft fees, but they continue to take money out of my account for transactions that have not posted or are still "floating".

Is this legal? How can my account have a positive available balance and still be overdrafted at the same time?
