Defective Phone, will not hold a charge, cricket will not fix or replace phone

I went in to a cricket store and bought 4 phones and aquired service. 1 phone for my self which is fine so far it's a UTStarcom CDM7126 the second one for my husband it's a Motor Razr V3s which is the phone in question. We have only had the phones for 2 weeks and already the phone will not keep a charge.

We went back to the store where we purchase it and the guy gave us an extra battery and told us to go to there head store where we can get the phone fix or replace. Well not only did they not fix the phone they said there were no other phones like it to replace it. So i sugested they give us another phone equal or lesser value. We were told they could not do that because my husband already talked on the phone over 30 minutes there for the phone was no longer new. Now we was in the store for over an hour waiting for 4 phones to be turn on. So they are telling me before we even lefth the store our phones were no good because they were no longer new if we talked on any one of them over 30 minutes. Thats crazy. How many people turn on the phones andmake a call befor the leave the store. Thats a natural thing to do now my husband has a phone with their wireless service that he cannot talk on. The other 2 phones were bought for my 11year old son and my 14 year old daughter.

It has only been 2 weeks sense we bought those phones so were still watin to see if these phones will be crap also. It dose not make any sense that a problem that could be easily solve by the cricket company, could turn in to a hell of a problem.
