Rocktops
Sells granite countertops. Took down payment of $2214. On order. Could not provide merchandise. Request for return of money. Did not receive. Rocktops closed doors 12/19/08. Employees terminated. No msg returned. No phones are being answered

A contract was written 10/31/08 for providing granite countertops for my kitchen. A deposit of $2214. Was given as down payment. After deciding on selection of design, a "measure date" of 11/25/08 was made with employee at
O'Fallon, Mo office. Jim who represented Rocktops arrived to measure but was unable to complete measure due to uneven cabinet in one area. He suggested that a handyman or construction person look at the problem. Contact was made immediately with a handyman who after examination, found a problem with the wall settling. More extensive work would be required to correct problem. Since it is winter, we could not tear into wall at this time. Both Jim and handyman advised sales manager, Mike Warren that the completion of this could not go forward. My husband also called Mr. Warren on 11/25/08 and I called on 11/28/08 again to request that since it was not possible to proceed, that the deposit be returned to me. Mr. Warren indicated it was not a problem as nothing had been cut nor removed from their inventory. He said he would call MI office on 12/2/08 and request refund. Having not received a check by 12/15/08 I tried to contact Mr. Warren and no call was returned. Left messages several times. On 12/22/08 I tried many times to call Rocktops but only message on their phone was for directions to office/warehouse. No message could be left this time. Message box was full. I contacted handyman to see if he knew anything since he was removing and installing countertops for Rocktops. He informed me tha Rocktops had closed their door on 12/19/08 and all employees were terminated. They have $2214 and I have nothing.
