Even 5 years after statute of limitations suttell and associates served me with court papers and then garnished my wages because they would not agree to our payments

I am in desparate need of help!!!

Back in 1999 my husband and I purchased a computer from Dell (before we got married).in December I was served with papers (my judgement) from Suttell & Associates on behalf of Dell.

They stated in the judgement that if I did answer all of the questions in the packet get it notorized and faxed to them by a certain time I would have to go to court.

I faxed them my information like they stated in the letter.in the paper work I sent back to them, it was stated how much we would put down and then pay every month after that.

When I called Suttell and Associates back they said they would have to contact the plantiff and see if they agree to those terms. Finally I called back and was informed that the plantiff did not agree. I tried until I was blue in the face to come to an agreement with them.

We were in the process of trying not to go into forclosure with our home so obviously money was an issue. They did not like the amount we wanted and could pay.

Then I received paper work in the mail for garnishment of wages. They had a court order to garnish my wages for 60 days. They did so. They took 25% out of 4 of my checks. They received over 700 dollars in that time.

My husband (soon to be my ex) called them to try to get them to agree again on a payment plan and they said no. They wanted us to pay them a certain amount that was it. They did not care whether or not we were losing our house or not. No negociations, no care in the world from them.

My husband and I are getting a divorce which will be final Nov. 21st. I called them myself and told them of this situation. They did not care. I told them that I cannot pay that much money a month because I have to now pay rent and I am on my own. They did not care.

Finally my husband agreed that we would pay them 300 dollars a month (even though we cannot afford it).

On September 30th my husband was informed he was being layed off because his company was downsizing. So now he is not working at all and that leaves me footing the bill.

I cannot afford that much on my own. My husband and I are separated and have been. The 300 dollars was an agrement between him and I and him paying most of the 300.

This is almost a new month and we have not payed them any money. I am really affraid they will start to garnish my wages again.

I found out that in the state of Washington open account collections is only 3 years. I has been 9 years since we bought that computer. That means it is 6 years past he statute of limitations.

I do not have the money to pay them 3200 more dollars and since they made me pay from my check I want my 700 back that they had no right to collect.
