Anypets.com any Pets DOT ComA NY PETS DOT COM Has any action been taken against James W. Schwinn?

To the all individuals speaking out on this site,

I am a victim of Any Pets DOT Com who sent me a different colored dog than the one featured on the site. I have posted on this site in an effort to not only vent but also to collect information on how recourse could best be sought. We have all hoped that this could be expedited by some group effort. There is a lot of encouragement to jump-start a class action lawsuit but no action as of yet.

The company shut their doors last year. Schwinn is still at large which is really sort of scary because he is a danger to society. We would all feel safer if he was off the streets.

Despite reports I have filed with PD and Atty. General they do not respond.

This guy knew what he was doing and probably had it planned out knowing nothing could be done about it. The only way to go after him would be by going after the company itself. If he is still filed as Incorporated (INC.) the only action that could be taken is criminal.

You are not likely to succeed in collecting any money from him as an individual. Especially if the company is filed as bankrupt. I don't know the laws of the State of FL regarding bankruptcy but I am fairly sure this applies.

I consider that no action has been taken because so many people have consulted with attorneys only to learn that they will not see any compensation for years. They would have to shell lawyer and courtroom fees they may never be reimbursed for by the offender.

In addition, I am of the opinion that Schwinn MIGHT be financially well off enough to pay cash for things such as automobiles and real estate. He will not require a credit check for anything but loans - which he may not really need. Especially if he has other slum-lord agendas like, I don't know, selling people?

My point is that a financial judgment stays on ones credit for 10 years. Then it disappears. The court and law enforcement cannot make someone pay. The statute of limitations for other credit blemishes (non litigation) remain on one's credit for 7 years.

(Safe Assumption based on opinion) What makes anyone think his credit report would hinder him in any way IF he (hypothetically) pays in cash?

The only way he is going to be held accountable for anything is through criminal charges if there are any to be justified.

If anyone has any new information about his guy being hauled off in a bus for prisoners please update me.
