Ripoff repairs not made promises not kept builder crooked as they get

Began with builder not allowing us to FHA finance, though the contract he wrote did not stipulate who lender COULD be. Were supposed to close 4/28/06. Builder allowed us to move in 4/26/06. Would not get required items for FHA finance, ie. 10 yr warranty and specific certs. Not required by Logan County such as builder's cert. And occupancy permit.

We had to change to conventional. New closing date set for 5/12/06. Day of he called to inform title co. He would not show due to disagreeing with closing costs that again were stipulated in the contract HE wrote. Hired real estate lawyer which did nothing, in the meantime he had our water shut off and stole the fuse from our outside A/C unit but with a friend's help got the crazy builder to close on 5/19 by us paying an additional $800. And we had a signed list of repairs to be done by them by 5/28/06 which was 30 days after original close date. Of course his daughter made all these promises and stuck us with a bill of over $500 in interest from 5/1 to 5/19. I already had included the interest of March and April into the cost of the house due to us not having a buyer for previous home by March 1.

We have minor problems and we have major problems. The major ones that are of most concern are standing water in yard when it rains. The yard was grated incorrectly and all neighbor's water runs into ours. Land slopes inward toward foundation. They plan to do nothing about it. Haven't even repaired anything on the repair list except adding 4 feet of guttering over patio.
I have already paid $300 for dirt to be brought in and have the garden bed re-contoured to slope away from home and have an estimate of over $2000 to install a french drain and add additional guttering to prevent the runoff from standing up against the home.in addition, he ran over our septic tank with a dozer and it is cracked. We should find out today how extensive the damage is to the unit.

To make a long story short if you have repairs to be made that are not finished prior to closing make sure to have an estimate of the repairs and have the title company put that amount of the builder's proceeds in an escrow so that they do not receive that money until the repairs are completed to your satisfaction, that way you at least have a little pull with the whole situation.
