Damaged 50" Hitachi Ripoff

On 10/15 purchased a 50"Hitachi Projection Tv at CC. Left the tv there as I was remodeling the room that it was going into. Returned a week later to pick up the set. Upon arriving home, proceeded to unpackage the set, remove cardboard, etc. Upon removal of the card board, noticed a hole on the side of the tv unit. Besides myself, there are 3 witnesses who saw the set was damaged upon removal of the box. Immediately put the carboard around the set, and returned to CC. Went inside to customer service and told the girl the problem, she advised me to back up to the loading dock, she would notify someone in receiving to remove the set and replace it with another tv. They removed the set from the truck, as I was waiting for them to bring out a new one, here comes the manager, and says to me, that they could not replace the set with a new one, because the damage was done after the tv left the store. There was no physical damage to the outside of the box. Needless to say... Corporate headquarters gave me the run around, Hitachi, etc... I have filed with small claims and have a court date of February 28. I am demanding my money back, as I already bought another tv with their competitor.
