Sold damaged Plasma 50" TV, refused exchange, no refund! Ripoff

Opened the factory sealed, undamaged box, to discover the screen broken. I hadn't removed the TV from it's styrofoam cradle. Put the top back on and returned to Circuit city to exchange for an undamaged unit. They took it into the receiving area, I went around to customer service and waited. After a while the TV was brought out and I was showed two large severely dented places on the top corners of the back metal portion of the TV. I explained that I hadn't noticed that damage, I had merely repackaged the set after seeing the broken screen. Since the box showed no signs of damage Circuit City has taken the position that I must have damaged it and therefore am liable for the damage, no exchange no refund! Have spoken with two store managers, two Corporate representatives and Hitachi customer service. All have cited policy and have offered no option.
