Overdraft Fee of $34 Charged on Posted but Uncleared Transactions

I have a bank account with Bank of America and over the past couple of months they have been over charging me with a $34 fee for transactions that were posted but have not been cleared on my account and now my account only has 24.61 instead $180.00 dollars.
I would like to close this account and open a different account at a different bank but I can't because what is going on with my account at BoA.
