Stolen Debit Card Led to Closed Account and Overdraft Charges

My debit card was stolen I didn't know until a few days later I thought my 1year old son got it and it was around the house some where but after my spouse checked our account the recording said our account had some checks pending in which we had no part of we asked if bank of America could cancel/stop the transaction, with out notifying us they said its to late they closed our account and that we are responsible for an overdraft amount with out even investigating us can they do that we are victims of a double crime here I don't know what to do can you help us
