Fraud wrote bad rent check using illegal drugs in my home inviting unauthorized guests into my home

My wife and I rented a room in our home to a young woman who is on disability and collecting Workers comp. Checks for an on-the-job back injury.

We quickly noticed she was not very sanitary. She complained about her exscrutiating back pain whenever we would ask her to clean up after herself. We witnessed her driving her full size van to bars. She could dance, play her guitar and have sex for long periods of time, but she couldn't load the dishwasher.

She has two cats. One of which was not litter trained. It urinated on many of our belongings, including furniture, clothing and photographs.

She would bring unauthorized guests into our home. We would come home to find complete strangers laying on our couch, in our living room, enjoying our Entertainment System and pressing random buttons on my somewhat complex programable remote control.

We started noticing a strange smell coming from her room. At first it smelled like cigarette smoke. She was well aware that we are non-smokers and that all smoking was to be done outside. The smell then changed from cigarette smoke to what we beleive was marijuana.

After she paid Dec. Rent on 12/1/04 we attempted to ask her to leave by 1/1/05. She became very upset and began screaming and yelling at my wife and slamming the door in her face. She would only act out like this while I was at work. When I would come home, she would be gone or locked in her room.

We got a lawyer. We Posted a 30 day notice on her door. She called the cops to our house and claimed we were harrassing her. The cop and our lawyer informed us that she is renting "a room" from us. Nothing more. Legally all we were required to provide her with was a room, kitchen and bathroom facilities.

We proceeded to take away all of the household luxuries. Such as, our entertainment system, our Microwave, our computer and our guest room where we allowed her to store furniture and other belongings that she couldn't fit into her room. We placed those items in the living room. We hoped she would put her belongings in her room. She did not.

On 12/6/04 she went on vacation to Rhode Island. While she was gone we began to decorate our home for X-mas. We had family and friends coming to visit for the holidays. We could not have her junk piled in our living room. I brought home boxes and carefully packed some of her belongings in boxes and put them in her room. I also put her console TV and Cat urine soaked loveseat in her room.

She left us a letter telling us that she was sueing us because we broke a lot of her belongings and having all of her things in her room has caused her to have more back problems. That same day I find out that she put "Stop Payment" on her rent check.

We spoke to a few of her former friends, roommates, and landlords. We soon figured out that we were victims of a con artist. She never has a job. She makes a living by sueing anyone she can and living off her winnings. Workers comp. Issues her a check because she claims she can't work. But she's played her guitar and been paid to perform at local bars.

After the check had cleared and I spent the money on X-mas presents and other expenses, her checked was returned and Bank Of America snatched the money back out of my account, which overdrew my account. The bank also hit me with a return check fee. For every charge that posted after my account was overdrawn, I was given a $33 overdraft fee.

Our lawyer gave us a 3 Day Notice to post on her door. She became violent and called the cops again. The cop was very kind and told her that she owes us money. It's the holidays and she really should just give us the money and get out.

On 12/16/04 by 3P.M. She was supposed to be removing all of her belongings and paying us 2 weeks worth of rent plus the overdraft fees. The cop was there to witness everything. She never showed up.

It's a week before X-mas. I've had to return x-mas gifts because I am flat broke. I've changed the locks and I'm currently attempting to sell her belongings.
