I was solicited for work by mr. Allen vechnak dba texas trust roofing for roof repairs after a major storm, in which i had damamge to my home in cedar hill tx, at the start didnt trust him due to he didnt want to provide written estimate for the damages for the charges for repairs, labor and supplies, we entered in an agreement for the roof repairs and a few other small items, in which the insurance company paid over 5000.00 for the roof repairs, mr vechnak recieed and cashed that chk and, went on to try to get more money for other items damaged to our home for windows and skylight damage, leak in ceiling window screens, and various other items, which he offerd to sumbit a supplement to my insurance company for payment, prior to the check coming for the supplement he started calling us about th check and says that we owe him the whole check, even though he did not do any other other repairs or replace any windows in my house, but he sent in a supplement payment bill for repairs with the intent of gettin the whole check but we didnt want to use him to do the other repairs we contacted our insuranc company and our adjuster informed us we do not have to have this man and his company do the supplemnt rapairs it is our choice to use whom we want our do it our selvs. So now he is sueing me for the check that h didnt earn. We did not do a contract discussing and or agreeing to him doing our supplement repairs. He is trying to force us to pay him money for work never did. I know i still owe him a small amt of money, i tried to pay him what was owed to him. Which is less than 2000.00, i even mailed him the chk but because he has no real mailng address we cant send him any coresspondance, it was returnd to me in the mail that the address on his business papers and card and business materials he gave is false not a good address, what company does not have a valid mailing address for customers to send correspondance, but he says because he sent the supplement request in to our insurnace company that is his check. Is this how contracors work, they try to trick consumers/new homeowners into added addtional claims to their insurance to get money when he knew all along he didnt fix any the items, so he is sueing me for almost 9000.00 with thecourt costs. During the first court appearance the judge noticed that something fraudelent was going on. And ordred another hearing, then when we were at the second hearing the judge seemed like he didnt understand what was going on with the papework and didn even look at it and ruled for the plaintiff, how can i get help in this matter, i cant afford to appeal the case the amt even though is a small claim case the money needed to do it is about 10,000. Which i dont hav and do not even owe this man and he has done this to many of my neighbors on the street where i live if he did an estimate for the roof repair and the person dint use him he took them to court to sue them for breech or contract. Help
