On November 29 at approximately 2:05PM I was driving nnorth on El Mirage Rd following Arizona Materials truck 278. A rock came flying from the top of the truck and struck my windshield, breaking it. I waved the driver over, and he give me the phone number to the office and said "call them and they will take care of it". He did not identify himself further. I called the office and they had me fill out a claim form, which I did. After 2 weeks I finally heard back (after several phone calls) that they claim they are not responsible as their trucks are always washed before they leave the plant, and this truck had just left the plant. They claim that the rock must have come off the road. I indicated to them that it did NOT come off the road, and came off of the top of the truck. They said my opinion is biased, so it does not matter and they (and their insurance company) refused to pay for my windshield. I even pointed out to them that the damage is 5'8" above the roadway, so it is unlikely that a rock from the roadway could have gone that high, since the truck has mud flaps to prevent that. I can see from the other complaint here, that they made the same statement to the other person. It must be thier "corporate line" to avoid paying legitimate claims that their trucks cause. I would not be filing a complaint if the rock had come from the roadway, but Arizona materials claims that every truck is perfectly clean when it leaves the plant, so they deny all claims. Had my windshield not held, this rock would have killed my wife, as it would have struck her in the head. Shame on you, Arizona Materials.
