Funtual.com

Internet & Web

On May 3rd my company was contracted to design the Funtual logo and all website related creatives. Per our agreement any services not outlined in our contract would require written authorization before I would complete them.
Additionally, our contract stated that any images that required purchasing would require written authorization as well. During the course of website design and development, Funtual owner, Pari Esfandiari, directly or through her
assistant Barbara Ellis, repeatedly made requests for number of services that were outside the contract or above and beyond what was specified in the contract. All requests were clearly documented, in writing through email, which
is legally binding.in each and every instant an exact time amount was given to complete the extra services, and the services were completed in a timely fashion under good faith that we would be compensated at the end of project.
Several images were also purchased, with written authorization from Pari Esfandiari.

When the project was completed on August 8th two invoices were submitted. One was for the remainder of the balance on our original agreement which compensation was received. The second invoice was for the $600 which included the cost of the purchase of the images she requested and for the additional services that were completed. Immediately following the submission of the second invoice, Ms. Esfandiari notified me by email that she would not make payment for the services rendered in the second invoice.

Instead she offered partial payment of $30 per hour when the my rate is $60 per hour stating that $10 per hour is what her offshore developers charge her. I responded and explained that her offer was unacceptable but in attempt to settle the matter quickly I would lower the rate to $50 per hour my cost of the purchase of the images. I also provided a
detailed description of what each additional service was provided, who authorized it, and why it was done. Ms. Esfandiari responded stating that should would not pay the reduced amount and that her final offer was for $330.

On 08/18 Virtual Entertainment was served with a demand for payment letter which went unanswered. As of the date of this report Funtual continues to use my logo, my base website design, and photos that I purchased without compensating me for balance of the project that is due.

I have ALL email correspondence between myself and Ms. Esfandiari, her assistant Barbara Ellis, as well as all contracts and proof of the work authorized and completed.

Virtual Entertainment of Las Vegas, AKA Funtual.com is not a honest organization. They do not upload their contracts, and fail to pay their subcontractors for work completed. I would highly advise any company or individual from doing business with them.
