Contract written to sound like what we expected, but wasn't delivered

BackBeat Media, contacted us in November offering us a fantastic advertising deal. We signed up, only to find that they were not delivering what they said that they would. We'd paid by credit card and contacted the credit card company.

What a roller coaster ride that took several months, of the credit card company crediting us, and then re-charging.

You see we have e-mails from before the contract and during the contract, illustrating that we should be receiving 100,000 impressions per month. However we never did. We tried to talk to them, to cancel the agreement. They just sat behind their company moto, you signed a contract that doesn't have a cancellation policy and they wouldn't budge!

At the end of the matter, VISA decided that they should keep some of the money, because their actual contract never stated 100,000 impressions per month. It doesn't matter that we were constantly told via e-mail 100,000 per month (and presented these e-mails to VISA). It was omitted from the contract and therefore it means that this company is entitled to the money. Ouch!

So watchout, BackBeat Media's contracts appear to be written in a way where you'll believe that it backs up what they say, in fact it means they don't have to and they can get away with it!
