The laptop was defective and the store is going to take 2 weeks to replace it

I purchased this laptop on 09/05/08 online. I picked it up 09/06/08 from the Arlington, TX store (in the Parks Mall). Once I got home we opened it and notice that the disc drive wasn't working properly. It was having trouble opening and closing. I took the computer back 09/07/08. They told me that they would have to special order one since they didn't have anymore in stock at the store. I said ok that's fine. They also said they would call me when they were ready to get my info and have me bring the computer in. They called and I took the computer back again 09/08/08. This time they kept the computer and told me they would get one from a store nearby and bring it to the store nearest me. Mind you, the store that I have already been to three times is about 20 miles from my home. They were supposed to call me on 09/11/08 to let me know to come and pick up my new computer. I never received a call. I called them at 10am on 09/12/08. I couldn't talk to a manager, they are all "in meetings". I called the district office and she supposedly couldn't get a hold of a manger either. I told her that I had been patient up until this point and now I would like a refund since they can't get me a new computer by the time I would need it. This computer was intended as a birthday gift. She in turn told me that I would have to pay a 15% restocking fee, which would come to about $90. I told her that was out of the question since they are the ones who couldn't hold up there end. I told her to connect me with someone over her. She connected me to someone in corporate. They were of no help either. He called the location in which I picked up the computer from. They told him that it would be Thursday, 09/18/08 before I could get a new computer. I asked if it was available at another store, I could go and pick it up. He said that I would just be paying for another computer if I was going to do that. I have to wait 2 weeks for a computer that I have already paid for, don't have, and can't get a full refund on. Is there not something wrong with this picture? If you can avoid Circuit City alltogether, that would best bet. They do not value their customers.
