Fraud! Selling USED games as new, threatens via email

On Jan 14 I made a puchase from mediamaxstore on Half.com for Baldur's Gate: Dark Alliance (Game Cube). The item was listed as NEW, specifically "Condition: Brand NewSealed in Shrinkwrap! Gift Quality! Ships first class w / delivery confirmation."

What I received was a USED game, that had been poorly re-wrapped in shrink wrap (it did not have the original wrapping). The Game Cube game had a DVD Security Seal saying "SECURITY DEVICE ENCLOSED" on the top of the plastic case, something no other Game Cube NEW games have. The game was NOT in a Game Cube plastic case, it was in a DVD replacement case. The game itself had scratches showing it had been resurfaced.

I called the company, where I was told by the incredibly rude person on the phone "we know and corrected the problem", but never offered a resolution. He told me to email and hung up.

The seller never responded to any of my emails about returning the item, so I had to file a claim with half.com to get my money back.
