Fraud! Selling USED games as new, threatens via email Endicott, NY

On January 30th, I made a purchase on half.com for several video games. After I placed my order, I realized I accidentallly made a purchase from mediamax, a company I had problems with in a previous order.

I immediately emailed the seller mediamax, and told them I did NOT want another used game that had been re-wrapped. I told them if the game was not factory new, just issue a full refund. I received the following reply:

Comment / Question: I personally inspected this item this morning before shipping, and it is as stated from our vendor. I am sorry that there was a problem with another item, I think it was a case of misclasification and data entry didn't realize that some cases of games we enter are "New" and some are "Like New". I have since clarified their mistake (we are all entitled to at least one) You have ordered from me in the past, and we have never had an issue before this incident. I am confident with our source of games (reputable vendor) and we have been buying from them for years. Thank you for your order.

I then received the following email:

Comment / Question: Dear Brian,

I spoke with Half.com customer service concerning this situation and with their help feel the best thing to do in this scenario is what they suggested. E-mail xxxxx@ebay.com and give her my decision to cease doing business with you. I would kindly ask that you order from someone else in the future. I received some information from them that was a little disconcerning and with their help came to this conclusion. I will not accept orders from you in the future, and will forward pictures of the product that was mailed to you yesterday to xxxxx@ebay.com. To prove it was in the condition I stated. I have never, in nine years on half.com, been treated this way by a buyer, nor will I accept this treatment in the future. Please do not order from me in the future.

I responded and told them their decision proves they know they are selling used games as new, and don't want to admit it. They clamied to have "scanned" the recent game they sent me and sent them to xxxxx@ebay.com, to prove it was new. When I received the second game, it was ALSO a used re-wrapped game. This time, I sent the following email:

You leave me no choice here.
I received your package today, but again, it was a used game re-wrapped.

I know this, because I purchased another at GameCrazy, with the proper shrinkwrap on it, and the proper security seal. I have already notified Half.com, and plan to file a police report for fraud.

You should be ashamed of yourself for threatening a buyer when you know for a fact you are re-wrapping games, or selling re-wrapped games as new.

I then sent xxxxx@ebay.com the following:

I took some pictures of the game I purchased at Game Crazy for $19.99, and the one sent to me from mediamaxstore. I am hoping these do prove my claim, that they are selling re-wrapped used games as new. Here they are:

You can clearly see by the scans (not the best pictures) that mediamaxstore does, in fact, sell re-wrapped used video games as new. Since they have refused to give me a refund, a Better Business Bureau complaint has also been filed.
