Scam Artist -Lied about actual Condition of Ipod that he sold to me. Sold a defective Ipod

I bought used ipod unit from this seller swadecook through ebay. His ad on Ebay read as following:

"I have for sale a white Ipod video 30gb.includes 4300 songs. This item includes the original box, software, headphones, armband sports case with strap for working out and usb cord. The item has some scratches on front and back but they are light just from normal wear and tear. Never been dropped and is great working condition. Upgrading to more GB which is why IM selling."

When I first got the unit on arrival the unit was completely dead. I had to plug it into my AC charger. The Ipod unit would hold a charge for 20 minutes and then completely die. No matter how many times I charged it the unit would not hold a charge. And to add insult to injury, this scam artist did not tell me the LCD screen had a big black smudge in it. This is LCD burn in. Suffice to say, this unit cannot be considered Great working condition. I knew it was used but he lied and misrepresented the actual condition. This Ipod is worn out. It's going to take well over $100 to fix the problems including labor. This guy refuses to give me my money back even though, I offered to mail the unit back.in looking at his previous buying history found in his profile, you can see he bought this unit used from another seller.
