DOA ebay item not replaced

I purchased from this guy on ebay.in his auction it clearly states that "DOA or wrong item received. We will offer an exchange for DOA or wrong dispatch. A refund will be offered in place of the item if stock is not available." My item was DOA. He did not honor this "exchange" on my transaction.

I would caution against purchasing anything from him. My item was not a lot of money, but being that, I wouldnt purchase anything from him being the way my auction was (mis) handled.
