Nisan Naveh - Niel44 Ebay Merchant Refuses to make good on returned goods for $325.00

I purchased 2 motherboards for merit countertop video games from this ebay merchant on feb 6th. These are new boards with a industry standard one year warranty. One worked fine the other failed and I contacted the merchant about a replacement. He said send it back he would send another one right away. I waited over a week after he recieved it and numerous emails later i was told that I damaged the board which is a lie, and that I would have to pay him half again ($165.50 plus shipping) For a replacement. I told him that was unacceptable and I wanted a refund or the board returned to me for an independant tech to look at. He has refused to respond and currently has my money and my cpu.
