Bought a guitar cab in April and after many excuses, Scott just avoids it, still!

In April, I responded to a Craigslist ad where Scott Donald was selling a 4x12 Langner guitar cabinet. I paid for the cab and shipping over paypal. He is in the bay area about 3 hours from me. After no response, he contacted me over email (never by phone) and said his mother was in the ER.

Two weeks later, he claimed he was helping his mother move to Burlingame. I didn't hear from him for another two weeks or a month, and by then paypal didn't allow me to dispute the purchase, because he intentionally gave excuses until the 45 day limit passed for paypal to allow you to file a claim. He then ignored me for months.

I found his phone number and left messages and he never called back. I emailed him numerous times. Every several months I'll attempt contact over the last THREE YEARS, and every 6 to 8 months, he'll email back asking for my address to ship it to. I give it to him and don't hear from him again. I actually had to call him from a friend's cell phone in the bay area and pretend I was someone else for him to even call me back. This was almost 3 years into him ignoring me and saying he'll send the guitar cab.

He was caught off guard and said "good trick, that was clever" when I said who I was and wanted to know about the guitar cab. He said he still has it, it's fine, he knows he needs to send it. I gave him my "new address" (that I've given him since two years ago), and he said he couldn't send it that day. I said "in the next two weeks is fine". He complained it was difficult to send. I said to just put packing wrap around it or cardboard. I'd rather have a damaged cab than no cab. I never heard from him again.

I've offered to pick the cab up, I've offered to have a friend pick it up, I've offered to maybe have someone we both ended up knowing in the bay area pick it up, or any of those people (me, a friend or the person we both ended up knowing) to meet him somewhere, if shipping is a problem. No reply, as usual. I asked that if it's a problem, to just refund me the money instead then. No reply, as usual. This has been ongoing for three years now and each time he completely avoids me and has no intention of sending this cab or doing the right thing.

He literally just shrugs the entire thing off. He knows he ripped me off and doesn't care about it at all. He doesn't deny it, he doesn't care who knows. It's quite odd. When talking to him on the phone he made some odd excuses about "downtime" in his life, as if that excuses him from explaining a problem to me, telling me he spent the money and can't refund or ship (I'd pick it up though), and just didn't have a good reason (he knew it). Just a completely off the wall conversation where he didn't even try and make an excuse and said "yeah, I know, I'll get it to you", but he clearly has no intention of doing so. Still no call back (ever, except when I had to pretend I was someone else to get a call back), no emails, no cab. Nothing. He doesn't care at all, and it's crazy. I just want the cab or a refund. It's simple.
