Sold laptop to me on ebay, PayPal had me return it to the seller, Seller refused to refund

When I recieved the laptop purchased through eBay/PayPal, it's cardboard packaging was dirty, and tore up. When I opened it, the laptop was wrapped in old, yellowed, egg foam. There was a fingernail/toenail, (I don't know which) inside the laptop. The screen was filthy like something liquid had been poured on it.

The only thing stated in the eBay auction as being wrong with the laptop is a missing 8 key. The auction also stated it only had a few minor scratches. There were several more things wrong with the laptop that were not listed in the auction. The scratches were major not minor. There were 3 or more hardware issues that do not allow the laptop to boot up. The screws on the bottom of the laptop were stripped. There were 3 shadow spots on the LCD. One is about the size of a nickel, one is about the size of a dime, and the other is about the size of a pea. They were in the middle of the screen and you couldn't miss them.

I emailed the seller, (Lemmy Paskel), to tell him of the major problems and he never responded. I filed a dispute with PayPal to which he never responded. Only after I upgraded the dispute to a claim did he respond, but only to PayPal, not on the dispute, or claim page. PalPal informed me that the seller was willing to refund my money if I returned the item.

I spent more money returning the laptop, (after I had put money into it), with signature confirmation.

Lemmy Paskel signed the receipt, and then proceeded to remove all moneies from his PayPal account, and freeze the accounts associated with it.

PayPal found in my favor but informed me that they could not give me any money because Lemmy Paskel took all of his funds out of his PayPal account.

PayPal was supposed to have protection for me up to $500. This transaction was just over $300. PayPal will not reimburse my money.

Lemmy Paskel is associated with Intelligent Network Systems. He uses it's address and phone number on his eBay account, so I think it's his business. I would not trust a business that is supposed to know about networking when they have no idea about computers. He/they LIE.

I think PayPal should have made sure the funds were in his account BEFORE having me return the laptop.
