Will not allow return of defective PlayStation3 because of software bundle

I purchased an 80GB PlayStation3 from Target. It quit working within three months. Every attempt at restoring the system failed, so I chose to return the defective product.

Because it was sold as a software bundle with an included PS3 game, I was not able to return the system. This would have been true even if I had tried to return it on the same day. I was informed that I could only exchange the system for another of the exact same type. None were available at this store. I was told to take the time (and gas money) to drive to another state and try and find one elsewhere. The Customer Service woman I spoke with wasn't able (or willing) to find out the availability in other stores, and Target refuses to ship between stores. I even tried calling Target corporate offices, to no avail.

The excuse given was "copyright issues" for software which cannot be copied. No efforts or offers of restitution were made, and so thus far I have a $500 paperweight. Apparently, whenever software is included with a product, functional or otherwise, their 90-Return Policy is not applicable. The problem with that in this situation is that the 80GB PlayStation3 was not sold without included software... All the systems were sold as bundles.

As far as I can find out, the 80GB PlayStation3 with SixAxis controller is no longer being shipped to stores. Sony isn't saying anything, but rumour has it that this particular bundle is no longer being produced for sale.

Word to the wise... Don't purchase software bundles whenever possible. We didn't even like the game that came with the system, and now a game we didn't want and didn't like is locking us in to keeping this $500 (short-lived) system. If it is going to die THAT fast, I don't want the system, I want a refund!
