Iphone ordered Jan 15,08' and still nothing

Phone ordered Jan. 15 08' after seeing the commercial on the television. I was confindent that this site was legal. After few weeks, i ask them about the tracking code. Told me that "it's on the way now." i insisted for a tracking code. But their phone representative told me that, i could have the tracking number when it reaches canada. I said thats ridicolous. I just hanged up the fone after that. Called them again last week, asking about the order. Now, they told me that the phone is on backordered. I can't believe that. 1st, its on its way, now, its backordered. Btw, i paid by interac online. I just want my money back if they can't give the goddamn phone.
