They sold me an opened projector in a resealed box. Ripoff

On Saturday night, March 17th I bought an InFocus IN26 as a new item from the CircuitCity store on the WestGate in Durham, which is the only store that has the item in stock.

However I decided not to open it until I got a game set the other day.
After that, I decided that I do not need the projector any more.

When I tried to return it to the CircuitCity in the Beaver Creek Commons on the Sunday, they ringed the ticket and then told me that,

The box was opened, and they have to change for a restocking fee.

I thought it was a joke and they just tried to get the restocking fee.

And the manager there opened the box and showed me that
the manufacture seal was broken.

Well, what will you think when you are in that situation?
It was the Durham store who sold me an opened box item as new!

So, I wanted to get back my box to deal with the Durham store.
However, the manager there won't let me do it, and keeping on charge me the restocking fee, stating that, the only way to get it back is to buy it back again.
Because there may be an evidence in the box to show that I have never touched the content in the box.

After arguing with them in vain, I asked them to keep the item in the store for the other day so that I can talk to the store director.

On the Monday afternoon when I called the director,
she said that, the item is gone, and I have no way to get the item and the restocking fee back.

Immediately, I looked for help from the Corp. However, the associate and the claimed top person on the phone line checked back to the store managers and told me that they assumed that I have opened the box.

The person talked about the same thing that the people who stands on the Circuit side would say, such as, they won't sell an opened box item in a box, etc.

I did not take other reports seriously until this kind of thing happened on me. Should we just protect us by checking carefully on their near unnoticiable reseal? Or, we may just be off from the stores.

I send a message to a local TV ripoff complain place. Hope they can alert people of this kind of issues.
