Ripoff refused to refund money on items he accepted as return

We purchased a Digital Antenna brand signal amplifier from Mobile Installations. (Cost $ 550 installation $125) As we drive across country we had plenty of opporunity to try it out and make sure it worked.

It didnt, and we caqlled the manufacturer to ask some questions and found out it was not installed properly, and it did not work as promised.

We contacted Dave about returning it to him. He agreed that we should return it, and we did so by certified mail.

After 30 days we called him again, because we hadnt recieved any refund. He ignored our calls, and after a while, about another 30 days, he put a recording on his phone that he was out of town temporarily.

I searched the internet to find his home number, called him, and spoke with his wife, who told me he was out of town for a funeral and would be back the following week.

The next week went by and no call. So I called again, this time I got a different story, she wasn't his wife anymore, and he had been in jail for who knows what?

He finally did call us and said he needed 2 weeks to get the money, which we agreed to. Amonth later we called him again, and he told us he didnt have the money and didnt know when he would have it.

My husband told him in no uncertain terms that we were not going away and he needed to pay, after all he had acce[pted the items back, and we now had no antenna, and no money.

I have filed a small claims lawsuit against him. We'll see if I can get any of our money returned. He owes us $625 plus lost time from work chasing him around.

Cingular in Chico, Cal. Recommends him, for their installations. I have contacted them about this and told them to STOP recommending him.
