iPod Returned Still Broken After Repair and Replacement Box Arrived Empty

I received my 20 G iPod ($399. Tax) at Christmas time. When I used it in January, I realized I could not get it to shut off. I put it aside. I called the company and they recommended I buy insurance and I did ($64.00). The technician told me to "boot" it up and shut it off. In doing this, it lost it's formatting and i sent it to them. It came back in worse shape and couldn't be turned off and within 24 hours didn't work at all. I spoke to them they promised me a "new " iPod. The following week an empty box arrived. They are investigating and although various people I have spoken with promise me a new iPod nothing has happened. Today I was angry and complained and later received an email that I will be receiving a used or refurbished or new (ha) iPod in the mail. What can I do. I wonder if the initial iPod was refurbished. What is my recourse. I want to take them to court.
