Homelite Generator Return Refused After Hurricane Sandy Use

I recently bought a Homelite Portable Generator from the S. Plainfield, NJ Home Depot on 10/25, days before Sandy hit NJ. The Home Depot attendant in the generator section sold me a generator that was already opened and on display and told me it was new. The receipt also shows that I have up to 30 days to return the generator, with no mention of the sale being final.

I went back to Home Depot to return the generator on 11/17 and was told that the sale is final and it cannot be returned since I used it during the hurricane. I explained that I took the risk of purchasing an already opened unit and as a result was given a $50 markdown, but again there was no mention of the sale being final. I am returning the generator since I need higher wattage (7000 watts instead of 5000 watts) for my home use, but Home Depot does not have the 7000-watt generator because it is on back order.

How do I resolve this issue? I even got a handwritten note from the Assistant Manager, Mike Hudson, conveying a Home Depot return policy that was not communicated to me at the time of purchase. The Home Depot store in S. Plainfield has posted a generator return policy sign at the return desk that was not there when I bought the generator before the hurricane. Please help, as I need to return this generator before 30 days from the date of purchase.
Thanks!
