Home Depot
Generator Return

Electronics and household app.

I recently bought a Homelite Portable Generator from S. Plainfield, NJ Home Depot on 10/25 - days before Sandy hit NJ. The Home Depot attendent in generator section sold me this generator that was already opened and on display - told me that its new. The receipt also shows that I have up to 30 days to return the generator and no mention of the sales being final. I went back to Home Depot to return the generator on 11/17 and was told that the Sale is final and cannot be returned since I used the generator during the Hurricane. I explained to them that I took the risk of purchasing an already opened unit and as a result a $50 markdown was given to me but again there was no mention of the sales being final. I am returning the generator since I am in need of higher wattage (7000Watts instead of 5000 watts) for my home use but Home Depot does not have the 7000 watt generator as they are in back order. How do I resolve this issue? I even got a hand written note from the Assistant Manager Mike Hudson conveying Home Depot's return policy that was not communicated to me at the time of purchase. Home Depot store in S. Plainfield has posted generator return policy sign in return desk that was not there when I bought the generoator before the hurricane. Please help as I need to return this generator before 30 days from date of purchase. Thanks! Suresh
