Ripped off They're cashing our checks but not crediting us

I am so glad we were not the only people going through all of this stress with this company. Back in July of 02 we received a notice stating we did not have insurance on our house when we did and like all of you we faxed it in to them as well as our insurance company. We didn't hear anything else about it so I thought it was taken care of.

We didn't receive a statement for the month of August but we still sent in the payment without the stub.in September we received a statement showing our payment being applied to hazzard insurance. We called and spoke with their representative. She told us to fax in another copy of our declaration page and it will be adjusted. Again we heard nothing from them until November when we were notified of the delinquency on our mortgage.

When we called to speak to them we were notified that our home was going into forclosure. We argued with them that we were never notified of any forclosure and we tried to tell them that we had insurance faxed it to them and they were supposed to adjust everything. No matter what we said they only wanted to know when we were going to be able to send in the 3500.00 to fix it all. We asked what was this all for we were told attorney's fees. WHAT attorney's fee are you talking about especially when there were never any legal papers sent to us we didn't even know about this until we called in. They could care less.

The next day we recieved papers from their attorney. We called and spoke with their manager trying to calmly explain that the payments were made but applied to other hazzard insurance twice and this is all due to their company's errors not us. No matter what we said nothing chaged. We were told either we pay now or lose the house. So we gave in we made a payment arragement with them. I didn't want to lose my house. They added the extra cost on to the mortgage in stead of paying 807.00 we pay 1046.00 for one year.

Here we are in July next month will be the last month of this but for the last three months i've been calling because i haven't recieved any statements. They gave me the address of the headquarters to send the payment to. I have been sending the payments and now they're notifying us the we are in default of our agreement because payment have not been received so our home will be in foreclosure again. I sent in a copy of my bank statement showing the checks being cashed and still we are being notified of our default now they have the right to forclose on us unless we pay again. They have another thing coming if they think they're going to get us again. If anyone has any suggestions please help.
