Prospect lending told my wife and me, that he was going to refund us the application fee

I was looking to purchase my first home and have dealt with 2 other mortgage bankers who were unsuccessful in helping my with this huge commitment. I was referred to Jeffrey Sosnicki from a realtor and he assurred me of all the doubts and worries I had from going through this process again. When the process started and paperwork was started I asked Jeffrey to go over all the fees that his company was charging. He told me that he was going to waive the application fee. We asked for a paper stating that he would waive this fee so there wouldn't be any conflicts in the end, but he gave me his word that he will fulfill this promise and convinced me that this letter wasn't necessary. Throughout this whole long process he continued to reassure me that there will be no issue in waiving the application fee. A few weeks before closing he then informed me that I would have to pay the application fee but he will then refund the fee right after the closing was finalized.
