Refused to refund application fee

I applied for a home loan thru Amerisave Mortgage Corporation, they accepted my application fee after I fully disclosed all details (as per their web site) about the property I intended to purchase. The following day a representative informs me that the cannot process my loan nor refund my application fee because they do not finance mix use condo's. The overwhelming majority of the condo's in America are Mix Use properties, I feel like this questions should of been asked before processing my application considering all the other details they asked about the loan.in any case the qualifications of the loan should be established and qualified before accepting funds...

I contacted the company for a refund (Anthony Fierro) only to be informed in writing that I would not receive a refund.
