Lied during sales process and won't let me return the spa

Construction & Repair

I purchased a spa at the National Event held in Erie, PA. The sales associate, Valerie, told me the spa has "one of the best warranties in the business" and the company has a "100% customer satisfaction policy." The only thing she didn't lie about was the decent price for the spa.

She exaggerated the warranty, delivery policy, return policy and quality of the spa I purchased. It was delivered filthy, with a temporary cover and missing a pillow. I was told it would be clean, the pillow would be there and the cover would be the same color as the base.

The warranty is the worst of 5 manufacturer's I've looked into. They only cover most items for 2 years. The other big manufacturer's have 5-7 year warranties.

The guarantee on the product is 100% customer satisfaction. When I discovered the lack of warranty and the poor quality for the price, I decided to return the spa. After being hung up on by their customer service rep, Ashley, I finally got her to stay on the phone to try to fix my problems.

During her explaination, it came to light that the person who sold me the spa is not one of their regular sales people and had no idea their delivery process or what needed to be special ordered. I told her I wasn't happy with the follow through (it had been almost 2 weeks and no pillow or new cover) or the fact she hung up on me. So, I decided I just wanted to return the spa.

I was told that if I send in my copy of the purchase order, they will pick up the spa and charge me 15% restock fee plus delivery/pickup charges. My PO says there is a 20% restock fee and no delivery/pickup charges assessed for returns. (I didn't know there was a back to my purchase order that explained any of this... I was told 100% guarantee not 80%).

I decided to see if I could get some of the restock fee waived since I was misled in the sales process. The owner of the company has now said I can't even return the spa. I don't understand why I could return it before and can't now. I just want to return the spa and not have to deal with this company again. I've sent several letters to the company and they keep insisting I'll be happy with the spa. I no longer want it.

I'm basically getting the runaround. The owner now wants to know what other companies I looked at... This information is in the first letter I sent them.in case you're wondering: Hot Spring, Mystic, Jacuzzi, and Dimension One... All better products.
