Sold Us the Lot From Hell

We bought a lot from Ryan Homes in Dec. 2000. At the time of purchase we were told the lot would have 90-60ft. Of wooded common area behind it and a 40ft. Tree barier running down the left side of the culdesac.

There was a map at the model home that showed the culdesac we were interested in building on, the common ground, and a culdesac with 13 lots that would eventually go in behind us. I specifically asked the rep if the 90-60ft. Of common area or tree line would change when the culdesac went in and she assured me it would not. I told her I was only interested in a wooded lot that provided complete privacy, at least in the summer and fall when the leaves were on the trees.

We were the first people to buy on the culdesac and had our choice of any lot, including others on another street. We bought the lot, had our dream home built, and one year later they put the culdesac in. Well, instead of the original 13 lots on it, they put 15 on it and included the woods with the 2 extra lots they sold! I paid a $6,000 premium for the wooded lot
while my neighbor who is RIGHT BEHIND ME did not pay a premium and got the woods with his lot!

To add insult to injury, he cut down every single tree on the property and there is now NO privacy what-so-ever. We are so close, we can actually watch TV together from our morning rooms! When we called the model home to find out what in the world happened to the 90-60ft. Of common ground we were supposed to have and rep said she didn't know anything about it. I asked her for phone numbers of who I could call to get some answers and she would not give them to me.

After weeks of no one from Ryan returning our calls, we filed a complaint with the BBB and they turned up the heat on Ryan Homes and made them call us. My husband demanded a meeting at the model home and an explanation of what happened to the common area. The explanation he was given was that the culdesac was surveyed incorrectly and cut wrong. This is an absolute lie because after it was surveyed I called Ryan Homes and told them to send someone out to have it checked because if they cut where it is staked out we were never going to have 90-60 ft. Of woods behind us.

They sent someone out on 2 separate occasions and both times we were told it was surveyed correctly! He asked my husband what it woud take to settle this and he said he wanted our $6,000 premuim back. The man from Ryan said it was unlikely and my husband walked out. He called my husband back a few minutes later and told him he really thought we could settle this.

Well, a week later we got an offer for half of the premium. When we got the Settlement and Release Agreement and read it, we decided to have a lawyer look it. He told us we should get the entire $6,000 back if not more and that Ryan was quilty of negligent misrepresentation and maybe even fraud. We did not sign the agreement are are now suing Ryan Homes.

It has been one lie after another with Ryan Homes. I cannot sell my home in the future as being on a wooded lot, which sells quicker than most lots and for more money, and I can't even enjoy my $276,000 home because I can't stand the lot it's on. This has caused tention with the neighbors behind us and I have tons of stress from dealing with Ryan Home's crap for the last 3 months!
