Won't refund deposit for work not done

In may my husband and i contracted mr. Beatty owner of cbc pools & spas to install an inground pool at our home. We gave him a deposit of 9701.63 to insure us to be the first on his list when he began inground installations in june.

He began to dig on june 13, the next day the dig was stopped by mississippi river transmission, reliant energy, due to an easement issue. They admitted to making a mistake by issuing a dig order and told mr. Beatty the pool could not be installed and for him to fill in the hole and put our yard back to normal

And that they would be responsiable for the work he had done since the dig order was given and for his work putting our yard back. We contacted mr. Beatty about refund of our deposit and was told he had spent our money and did not have it to give us,

But that as soon as the gas co paid him he would pay us. For months he argued with the gas co as he wanted them to pay him the amount of the contract for the pool he did not install.

Finally he agreed to 6877.00 (5100.00 for his work and 1700.00 for his down time). We were told by mr. Beatty that as soon as he recieved the check he would give us the complete amount they sent him and that he would need to make payments on the balance he owed to us. On sept. 29 he recieved a check for 6877.00 from the gas co., they let us know they had sent us the check as no one trusted mr. Beatty to pay it to us as promised.

My husband called and left messages at his business for a week and he never returned our calls so finally we called his cell phone. He told us on oct. 10 that he had the check and he would pay us the whole amount of 6877.00 on oct. 15. When my husband went to his place of business to collect mr. Beatty gave him a check for 5000.00, when asked about the 1877.00 difference he said he did not have it and that he would pay us the balance of 4701.63 when he could.

This is totally unacceptable as he has lied to us for 4 months concerning a deposit that should have been returned the day he was notified the pool could not be installed. This man has went so far as to cuss me on the phone, which
