Sold us a hot tub on ebay then never delivered

We purchased a hot tub on ebay, they said they had to make it according to our specs. Color, exterior material etc. This was to take 6-8 weeks. Then they said they hadn't returned my emails because he was out of the country and his partners did not return any emails but we were not to worry as it was being sent out. Then after repeated emails, they said it had been sent out to the wrong address, but was coming back to them for reinspection then would be sent out to us.By now our time period is up for us to complain to ebay as you only have 60 days. But as it seemed legitamite, we believed them. Now the phone is disconnected and they are not returning any emails. We are afraid we have been scammed.
