Furniture goes flying

We purchased (the purchase process is another story) a leather sectional and ottoman from Hanks.
We came with 2 pick ups to load the furniture on Saturday, Jan 5. The Hanks people loaded th long part of the sectional in one truck and the shorter part in the second truck. The question was where to put the ottoman. The loaders then suggested we put the ottoman in the cab of one of the trucks. Yes, we said that was fine. At this point my husband signed the release of the furniture. The man placed the ottoman in the front of the larger truck. He thought it was a little close in the cab. At this point, the other stockman, said it would fit beside the shorter part of the sectional. The ottoman was placed there. They said, "We are all done. You can go." My husband and I left the store lot. Approximately, 3 miles away from the store along a stretch of 4 lane traffic something flew out. At first I thought it was cushions. I called my husband and told him to call Hanks about what happened. I had to find a turn around point. This I did.By now I have figured out it wasn't cushions, but the ottoman.By the time I got back to retrieve the ottoman someone had stolen it. I am thankful, the ottoman did not hit any cars. Now, that would be interesting!

My husband had immediately called Hanks about the "cushions". Now, I am calling Hanks. The person on the phone said, "There were no cushions". And I told them, "I know it was the ottoman." I said, "What can you do about this?" Of course, they sent me to my salesperson, Gary. Gary said, "Once it leaves the store, it's your responsibility." I said, "But, it's your responsibility to at least use reasonable care in loading the furniture, since your people are the ones who do that. That is negligence on your part."

The real problem is, we had purchased the furniture insurance. If we had a smashed, broken, whatever ottoman. They would replace it, but since it was stolen, we have nothing to give them.

Luckily, we paid with a credit card. We will see how it comes out.
