Walk behind self propelled mowers Series 440 Ripoff

Purchased a new TroyBilt walk behind Series 440 self propelled mower from a major home improvement center, paid $320.00 for it and have used it 4 times only to have the self propel unit give out!
Found out from the retailer that these model series was recalled by the manufacturer in however customers who had already purchased one were NOT notified, and any units the retailer had in stock were NOT recalled! So any mowers the retailer had in warehouses that were left over in 2006 and even into 2007 were defective!
My unit has an electric start which I really like, and it still runs and mows, I just have to push it, instead of it pulling itself... Which is the real reason I bought it to begin with!
Will just have to wait until the winter to take it in for repairs. Seems like the manufacturer should have to repair ALL units made in that year, prior to the recall being issued.
