Real estate agent, has mugged our deposit

A real estate agent, Yimin Chun, also called TOM, has cheated us. At the beginning of this year, we were planning to buy a house, so he, introduced by a friend of ours, showed us a couple, and then just pushed us to close the deal. We are not really ready to make the final decision, so no deals.

At the time, he convinced us it's a routine that we had to write him a check of 100 dollars to even start negotiating the price, but he promised, if we would have a deal, it would be part of the closing fee; if there won't be deal, he would just return it back to us.

But we later on decided it's not a good timing for us to buy the house, but maybe during summer time, we can reconsider it. Because he's kind of friendly to us, much-disguised fellow, so we did not ask the check back, and he promised us he would use the 100 dollars for our further deposit if we still want to buy a house from him. And we agreed.

Then 2 months later, last week, he suddenly and silently cashed the check. When we called him to ask why, he had contradictive explanations each time, but just won't give the money back to us since he thought there won't be any business from us in near future. The most recent reason he provided, which has been recorded by us, is that he hired a lawyer for us to make the contract with the seller.

As far as we remember, he only provided us a list of lawyers as reference. We even did not start calling any of them, and we did not authorize TOM to do it. Until now, he could not provide any evidence about where our 100 dollars went. We tried to contact his company, but we cannot find it through website or yellow page. There is no way that we can complain this issue.

He lies and lies again and no honor and dignities at all as his age, almost 60, should have brought to him. Please beware his name above and his infamous company: Wedi Realty Corp (if there is one).
